These Terms and Conditions outline the agreement between The ICT Shak Pty Ltd (“we”, “us”, “our”) and the customer (“you”, “your”) for the use of the Lead Machine CRM, including the 30‑day free trial, paid plans, usage‑based charges and add‑ons.
By creating an account, accessing the CRM or using any part of the service, you agree to be bound by these Terms and Conditions.
The term "credit card" refers to either a valid "credit/debit" card in this document.
1. Service Overview
Lead Machine CRM is provided by The ICT Shak as a white‑labelled solution built on an industry‑leading CRM platform technology provider.
The platform includes customer management tools, sales pipelines, communication tools, marketing automation and optional add‑on features.
The CRM is accessed on a subscription basis. Certain features may incur additional usage‑based charges.
2. Free Trial – 30 Days
A 30‑day free trial is available to eligible new customers and provides access to standard features unless otherwise stated.
- A valid, active credit card is required to activate the trial via the Client Portal.
- Subscription fees are not billed until the trial ends.
- Usage‑based charges (SMS, emails, calls or similar pass-through costs) may still apply during the trial.
If you choose not to continue after the trial, cancellation must occur before the trial ends.
3. Subscription Billing
Lead Machine CRM subscriptions are billed monthly in advance to the credit card stored in your Client Portal account.
Your subscription renews automatically each month until cancelled.
Failure to maintain a valid payment method may result in suspension or termination of access.
4. Usage‑Based Charges and Rebilling
Certain CRM features incur usage‑based charges, including but not limited to:
- SMS and MMS messages
- Email sending
- Phone call usage and call tracking
- AI credits
- Other passthrough third‑party fees
To enable automated rebilling for these usage‑based charges, a valid credit card must be stored within the CRM itself, in addition to the card stored in your Client Portal.
Without an active credit card in the CRM:
- Usage‑based features will not operate
- Automations, communications or campaigns may fail to send
5. Add‑Ons and Upgrades
Optional add‑on features may attract additional recurring fees or usage‑based charges.
By enabling or using an add‑on, you agree to the associated pricing shown within the CRM or provided by The ICT Shak.
6. Cancellation Policy
You may cancel your subscription at any time through the Client Portal.
- The cancellation becomes effective at the end of your current billing cycle.
- Refunds are not provided for partial months or unused time.
- Access to your CRM account and its contents ends when your billing period concludes.
- You are responsible for exporting all required data before cancellation.
If your account is suspended or cancelled due to unpaid charges, data may no longer be recoverable.
7. Data Ownership and Responsibility
You own all data that you load into the Lead Machine CRM.
This includes contacts, conversations, notes, uploaded documents and any data generated by your use of the platform.
Your responsibilities include:
- Maintaining any backups that you require
- Exporting your data before cancellation or suspension
- Ensuring compliance with all Australian privacy, spam and telecommunication laws
The ICT Shak is not responsible for data loss that results from your failure to back up or export data, from unpaid charges or from cancellation of the account.
How this relates to the underlying CRM platform
Lead Machine CRM is delivered using a white‑labelled version of a leading global CRM platform.
The platform provider hosts and operates the underlying system infrastructure while The ICT Shak manages your subscription and provides direct service and support.
This means:
- You retain full ownership of your data.
- Your data is stored on the platform provider’s servers.
- The platform provider does not own your data.
- The ICT Shak only accesses your data for support purposes.
- Data recovery or deletion is subject to the platform provider’s technical capabilities.
Regular exports or backups are strongly recommended because data may not be recoverable after suspension or termination.
Cross‑Reference to Platform Terms
Your use of Lead Machine CRM is also subject to the technical and platform policies of the underlying CRM provider.

8. Acceptable Use
The CRM must not be used to:
- Send spam or unsolicited communications
- Violate Australian privacy, spam or telecommunication laws
- Upload unlawful or harmful content
- Interfere with platform security or performance
Misuse may result in suspension or termination.
9. Platform Availability
Although reasonable efforts are made to ensure reliable access, uninterrupted service cannot be guaranteed due to scheduled maintenance, technical issues or third‑party outages related to the underlying CRM provider.
10. Limitation of Liability
To the extent permitted by Australian law:
- The ICT Shak is not liable for loss of data, business interruption, lost profits or indirect or consequential damages.
- Liability is limited to the amount paid by you in the 30 days prior to any claim.
11. Amendments
These Terms and Conditions may be updated from time to time.
Continued use of the CRM after updates indicates acceptance of the revised terms.
