The following policy applies to the WebMatix website platform.
By ordering a WebMatix website and making the first payment, you are agreeing to the following Terms and Conditions:
These Terms & Conditions apply to all services provided via the WebMatix website platform by The ICT Shak.
1. Proprietary Licensed Platform
- WebMatix is a licensed proprietary website platform.
- It is not open-source software and is locked to The ICT Shak’s hosting environment.
- The platform cannot be transferred, exported, or moved to any other hosting environment under any circumstances.
- The client is not permitted to store, resell or give away their website to any other person without prior authorisation or arrangement is approved by The ICT Shak.
2. Hosting & Access
- Websites built on the WebMatix platform must remain hosted on The ICT Shak’s servers.
- The website is tied to our environment and cannot operate outside of this infrastructure.
3. Ownership of Content
- While the WebMatix platform remains the property of its licensor and The ICT Shak, clients retain ownership of their website content, including text, images, and uploaded files.
- Clients are responsible for keeping a copy of any content they wish to retain.
- Upon cancellation of the service, all hosting accounts and website data will be permanently deleted at the conclusion of the current billing cycle.
4. Payment & Renewal
- Services are provided on a pre-paid basis, either monthly or annually.
- Issuing of an invoice constitutes an invitation to renew.
- Payment of the invoice confirms acceptance of the service for the new billing cycle.
- The ICT Shak reserves the right to decline renewal at its discretion, with no liability for any resulting loss or damage.
5. Non-Payment & Termination
- If payment is not received for the platform service, the website and hosting account will be suspended and subsequently deleted in accordance with our Billing Policy and these Terms & Conditions.
- If the client chooses to cancel during an active billing cycle, no refunds will be issued for the unused portion of that cycle. No further invoices will be raised after cancellation.
6. Deletion of Website on Account Closure
- Once the WebMatix service is cancelled, or if payment is not received, the website and all associated data will be permanently deleted at the end of the billing period.
- Under no circumstances will the website or its files be made available for transfer to another provider.
